Brief History and Regulations
The United States has extensive laws regulating the use of asbestos at the federal, state, and local level. Asbestos was one of the first hazardous air pollutants regulated under Section 112 of the Clean Air Act of 1970. Further, many applications of Asbestos were also forbidden by the Toxic Substances Control Act (TSCA) of 1976. This legislation regulates the introduction of new or already existing chemicals, and it is administered by the Environmental Protection Agency (EPA).
In 1989, the EPA issued a final rule under Section 6 of the TSCA banning most asbestos-containing products. However, in 1991 this rule was vacated and remanded by the Fifth Circuit Court of Appeals. As a result, most of the original ban on the manufacture, importation, processing, or distribution in commerce for the majority of the asbestos-containing products originally covered in the 1989 final rule was overturned.
